Terms and Conditions
Bookings are made and accepted only on the following conditions.
Personal Injury:
We accept no responsibility for personal injury to Guests, or loss of or damage to their property, or for other matters over which we have no control.
Holiday Tenancy:
This agreement is made on the basis that 19 Fistral Court is to be occupied by the Tenant for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the Tenant acknowledges that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when ends.
Over 18:
Bookings cannot be accepted from anyone under 18 years old.
Deposit:
A deposit of £100 must be sent within 5 days of confirmation of your booking. Please make cheques payable to S. C. Pace. Deposits are non-returnable unless we are unable to accept the booking as specified below.
Balance of Payment:
Once a booking is confirmed by us, the Guest is responsible for the balance of the cost of the holiday 8 weeks before arrival.
Non-payment of Balance:
We reserve the right to re-let any holiday where the balance outstanding is more than 2 weeks in arrears. However if we are unable to re-let the holiday you will remain liable for the outstanding balance.
Accommodation Becoming Unavailable:
In the event of the accommodation becoming unavailable (e.g. through fire or illness), we will endeavour to provide suitable alternative accommodation or will refund all monies paid or a proportion in case of curtailment.
Insurance:
Each guest will be responsible to take out adequate holiday and cancellation insurance.
Cancellations:
In the event of cancellations not covered by insurance, we will endeavour to re-let the accommodation, and if successful the balance of the full cost will not be due, or if already paid, will be refunded. The deposit is retained.
Damage and Breakages:
The holidaymaker must report any damage or breakages made during the holiday occupancy. You will not be charged for minor breakages. A security bond of £100 will be taken at the time the balance is due. This is refundable in full where appropriate. Damage will be taken to include any rubbish left at the property which is not disposed of as indicated in the welcome pack - in black refuse sacks, before being placed in the wheelie bin - as the owner will incur costs for its removal otherwise.
Breaking the Terms & Conditions:
The Holidaymakers rights to occupy the property may be forfeited without compensation if: (a) More people than specified on the Booking Form and/or the number the property holds, attempt to take up occupation. (b) Overnight guests are entertained without the Owners express permission. (c) Any activity is undertaken which may cause unreasonable damage, noise or disturbance; please respect the neighbours.
Complaints:
In the event of there being cause of complaint concerning a property, the matter should be taken up with the owner at once. It is important that this is done whilst you are still in the property so that an on-the-spot investigation can be made if necessary and remedial action taken if required. In no circumstances will compensation be made for complaints raised after the tenancy has ended when the Tenant has denied the Owner the opportunity of investigating the complaint and endeavouring to put matters right during the tenancy.
Access by the Owner:
The Property Owner or his representative shall be allowed access to the holiday accommodation at any reasonable time during the holiday occupancy.
Booking Procedure:
Bookings are Friday to Friday. Outside the main holiday periods and during the winter mid-week or short breaks can usually be arranged. It is not necessary for you to fill all the beds in the property; the price is for the Holiday Home not per person.
When we receive your booking form and deposit, we will send you a confirmation of booking and details of the balance due by e-mail. Provisional bookings will only be held for 5 days pending receipt of your deposit. The balance of the cost should reach us 8 weeks before you start your holiday.
Late Bookings:
Bookings made less than 8 weeks before the starting date of the holiday should be accompanied by the full payment.
Dogs / Pets:
Are not accepted at this property.
Arriving & Departing:
In order that your accommodation can be properly prepared, it is important that you do not arrive before 3.00pm and that you depart by 10.00am.
Smoking:
We operate a no smoking policy.
